Your Honor,

The period for discovery has ended. That being said the prosecution has not come forth on the docket with any evidence of my client's alleged wrongdoing. Considering that the burden of proof is on the accuser, there is no evidence to present against my client, simply charges against him. In addition, there is not a single witness that has been listed to testify as well.

The defense motions for a dismissal with prejudice due to the lack of evidence and witnesses presented against Gunner Lenty. My client cannot have a proper defense if the prosecution does not provide the evidence or witnesses brought against him.

Your honor, the State would request an extension for Discovery. We are working to obtain any and all evidence from the police force, but they are quite busy with the city's current state of affairs. We request an extension to the date of September 3rd, 2022 at 12:01am est.

@Dante Lock and @William Wheeler, Mr. Key and Mr. Wheeler,

For the Motion to Dismiss, this will be denied. As a cautionary note, it is highly advisable to avoid an imperative motioning of dismissal with/without prejudice as it can be taken as order to the courts.

For the motion to Extend Discovery until September 3rd, it will be approved and it will end on September 3rd, 2022, 11:59 PM EST. However, Mr. Key, the court will ask you post the indictment as due to a technical error, it was not transferred to this docket. The reason for extending Discovery is also in line with the accused's 6th Amendment right and under the provisions laid out under Federal Rules of Criminal Procedure, Rule 16(d).

With these motions ruled, the trial date will be set between September 4th thru 10th, 2022.
